Terms of Service - Alladro

1. Acceptance of Terms

By accessing, downloading, installing, or using the Alladro mobile application ("App", "Service", "Platform", "we", "us", "our"), you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms in their entirety, you are expressly prohibited from using the Service and must discontinue use immediately.

2. Description of Service

Alladro is a community-based platform that enables users to share and view user-generated information about alleged safety incidents, crime events, and related matters in their local area. The Service operates solely as a passive technical intermediary and hosting platform that:

• Provides technical infrastructure for users to post, share, and access user-generated content
• Does not create, verify, or endorse any content posted by users
• Does not investigate, validate, or authenticate incident reports
• Acts only as a conduit for user communications
• Exercises no editorial control over user content

3. User-Generated Content and Platform Immunity

3.1 Content Responsibility

• You are solely and exclusively responsible for all content you post, share, upload, transmit, or make available through the Platform
• Alladro acts solely as a passive intermediary technical service provider under EU Directive 2000/31/EC (E-Commerce Directive), EU Digital Services Act (DSA), and Italian Legislative Decree 70/2003
• We do not monitor, pre-screen, edit, or control user-generated content before publication
• We do not endorse, verify, guarantee, or take responsibility for the accuracy, completeness, reliability, or legality of any user-generated content
• All content reflects exclusively the views, opinions, and statements of individual users, not Alladro, its operators, employees, or affiliates
• You retain all legal responsibility for content you create, including liability for defamation, privacy violations, false reporting, and any other legal claims

3.2 Content Disclaimer

• No Warranty of Accuracy: Information posted by users may be false, inaccurate, incomplete, outdated, misleading, defamatory, or fabricated
• No Verification: We do not verify, investigate, confirm, or authenticate the truthfulness of reported incidents, user claims, or any factual assertions
• No Editorial Control: We do not exercise editorial control, journalistic oversight, or content curation over user submissions
• Automated Systems: Content may be processed by automated moderation systems, artificial intelligence, or third-party tools without human review
• No Police Reports: Reports on Alladro are not official police reports and have no legal evidentiary value
• Unverified Allegations: All crime reports are unverified allegations that may be false, mistaken, or malicious
• No Investigation: We do not conduct investigations, fact-checking, or forensic analysis of reported events
• Delayed Moderation: Content moderation may occur hours or days after publication; harmful content may be temporarily visible

3.3 Platform Immunity and Legal Safe Harbor

• Safe Harbor Protection: Alladro operates under safe harbor provisions for user-generated content platforms pursuant to:
  • EU Directive 2000/31/EC (E-Commerce Directive), Article 14
  • EU Digital Services Act (Regulation 2022/2065), Articles 4-6
  • Italian Legislative Decree 70/2003, Article 16
  • 47 U.S.C. § 230 (Communications Decency Act) where applicable
• No Liability for User Actions: We are not liable for any actions, statements, content, or omissions of users
• Technical Infrastructure Only: We provide only the technical infrastructure, data storage, and network connectivity for user communications
• No Publisher Status: Alladro is not the publisher, author, editor, or speaker of user content
• No Endorsement: The presence of content on the Platform does not constitute endorsement, verification, or adoption by Alladro

3.4 Alleged Crime Reports - Special Disclaimers

• Not Official Reports: Crime reports on Alladro are NOT official police reports and have NO legal status
• Unverified Allegations: All reports are unverified allegations from anonymous or pseudonymous users
• False Reports Risk: Reports may be false, mistaken, exaggerated, or maliciously fabricated
• No Corroboration: We do not corroborate reports with law enforcement, witnesses, or other evidence
• Presumption of Innocence: No person, property, or location mentioned in reports should be presumed guilty of any wrongdoing
• Do Not Act on Reports: Do not take any action based solely on information from Alladro; verify independently through official sources
• Report to Authorities: If you witness or are victim of a crime, report to law enforcement directly, not only through Alladro

4. Prohibited Content and Conduct

By using the Service, you represent and warrant that you will NOT:

• Violate Laws: Post content that violates any applicable local, national, or international laws or regulations
• False Information: Post deliberately false, fabricated, defamatory, libelous, or misleading information
• False Crime Reports: File false reports of crimes that did not occur or knowingly exaggerate incidents
• Defamation: Post content that defames, disparages, or falsely accuses any person, business, or property
• Privacy Violations: Post personal information, images, or data of others without their explicit consent
• Intellectual Property: Infringe copyrights, trademarks, trade secrets, or other intellectual property rights
• Harassment: Harass, stalk, threaten, intimidate, or abuse other users
• Hate Speech: Post racist, discriminatory, hateful, or violent content
• Illegal Activities: Promote, facilitate, or coordinate illegal activities including drug trafficking, weapon sales, or violence
• Vigilante Justice: Incite, organize, or encourage vigilante justice, mob action, or extrajudicial punishment
• Impersonation: Impersonate any person, entity, or law enforcement official
• Spam: Post spam, advertisements, solicitations, or commercial content
• Malicious Code: Upload viruses, malware, or any harmful code
• Platform Manipulation: Manipulate voting, reporting, or ranking systems
• Automated Access: Use bots, scrapers, or automated tools to access the Service
• Data Mining: Scrape, harvest, or collect user data for any purpose
• Reverse Engineering: Reverse engineer, decompile, or disassemble the App
• Multiple Accounts: Create multiple accounts to evade bans or manipulate the platform

4.1 User Liability for Violations

• Comply with all applicable defamation, privacy, and criminal laws regarding your content
• Obtain all necessary permissions, releases, and rights before posting content about others
• Verify the accuracy of information before posting crime allegations
• Accept full legal responsibility for false, defamatory, or privacy-violating content you create
• Defend and indemnify Alladro against any claims arising from your content

4.2 Violation Consequences

• Discretionary Enforcement: We reserve the right, but have no obligation, to remove content and terminate accounts for violations
• No Duty to Act: We have no duty to monitor, detect, or remove violating content
• Immediate Termination: We may terminate your account immediately without notice for any violation
• No Refund: No refunds or compensation for terminated accounts
• Law Enforcement Cooperation: We may report illegal activity to law enforcement and cooperate with investigations
• Legal Action: We may pursue civil or criminal legal action against users who violate these Terms

5. Limitation of Liability

• NO LIABILITY FOR CRIME REPORTS: We are NOT responsible for any security incidents, crimes, or events reported on the platform, whether accurate or false
• NO LIABILITY FOR PERSONAL SAFETY: Users use all safety information, crime data, and location information AT THEIR OWN RISK
• NO LIABILITY FOR RELIANCE: We are NOT liable if you rely on user-generated content for any decision or action
• NO LIABILITY FOR DATA ACCURACY: We do NOT guarantee accuracy, completeness, or reliability of location data, incident data, user data, or any other information
• NO LIABILITY FOR SERVICE INTERRUPTION: We are NOT liable for service downtime, technical issues, data loss, or system failures
• NO LIABILITY FOR DEFAMATION: We are NOT liable for defamatory, false, or damaging statements made by users about any person, business, property, or location
• NO LIABILITY FOR PRIVACY VIOLATIONS: We are NOT liable for privacy violations, doxxing, or unauthorized disclosure of personal information by users
• NO LIABILITY FOR IMAGES: We are NOT liable for images uploaded by users, including copyrighted, defamatory, or privacy-violating images
• NO LIABILITY FOR GEOLOCATION: We are NOT liable for inaccurate, imprecise, or misleading geolocation data
• NO LIABILITY FOR MODERATION: We are NOT liable for failure to moderate, remove, or flag inappropriate content
• NO LIABILITY FOR FALSE ACCUSATIONS: We are NOT liable for false accusations, wrongful allegations, or reputational harm caused by user content
• NO LIABILITY FOR AUTOMATED DECISIONS: We are NOT liable for errors, bias, or failures of automated moderation systems or AI tools
• NO LIABILITY FOR THIRD PARTY SERVICES: We are NOT liable for failures or actions of third-party services including Supabase, Google Maps, or advertising networks

5.3 Use at Your Own Risk

• Use of the Service is AT YOUR SOLE RISK
• You are solely responsible for verifying any information before relying on it
• You should independently verify crime reports through official law enforcement sources
• You should NOT make significant decisions (real estate, travel, safety) based solely on Alladro content
• You assume all risk of harm from user interactions, content exposure, or reliance on platform data

• Claims, demands, actions, suits, proceedings, or investigations
• Liabilities, damages, settlements, penalties, fines, or costs (including reasonable attorneys' fees)

7.1 Indemnification Triggers

Arising from or relating to:

• Your Use of Service: Your access to or use of the Service in any manner
• Your Content: Any content you post, upload, transmit, share, or make available through the Platform
• Terms Violation: Your violation of these Terms or any applicable law or regulation
• Rights Violation: Your violation of any rights of another party including:
  • Privacy rights, publicity rights, or data protection rights
  • Intellectual property rights (copyright, trademark, patent, trade secret)
  • Defamation, libel, or slander
  • False light or emotional distress
• False Reporting: Your posting of false, fabricated, or misleading crime reports or incident information
• Defamatory Content: Your posting of defamatory or damaging statements about any person, business, property, or location
• Image Upload: Your uploading of images that violate copyright, privacy, or other rights
• User Interactions: Your interactions with other users including harassment, threats, or abuse
• Negligence: Any negligent acts or omissions by you in connection with the Service
• Third Party Claims: Any claims by third parties arising from your use of the Service

7.2 Indemnification Obligations

Your indemnification obligations include:

• Promptly notifying us of any third-party claim (but failure to notify does not relieve your obligations except to extent prejudiced)
• Cooperating fully with our defense
• Not settling any claim without our prior written consent
• Paying all costs, damages, settlements, and attorneys' fees
• Accepting our control of the defense and settlement (at our option)

7.3 Survival

This indemnification obligation survives termination of your account and these Terms.

8. Intellectual Property and Content Licensing

8.1 User Content License Grant

By posting content to Alladro, you grant us:

• A worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to:
  • Use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your content
  • Incorporate your content into other works in any format or medium
  • Sublicense these rights to third parties including service providers, partners, and affiliates
• This license survives termination of your account
• We may use your content for operational, promotional, and commercial purposes

8.2 User Representations and Warranties

By posting content, you represent and warrant that:

• You own or have obtained all necessary rights, licenses, consents, and permissions for the content
• The content does not infringe any copyright, trademark, patent, trade secret, or other intellectual property rights
• The content does not violate any privacy, publicity, or data protection rights
• You have obtained consent from all identifiable individuals in images or videos
• You have the right to grant the license described above
• The content is accurate and not misleading (to the best of your knowledge)

8.3 Copyright Infringement and DMCA

We respect intellectual property rights. If you believe content on Alladro infringes your copyright, you may submit a DMCA takedown notice to: [YOUR_EMAIL]

Your notice must include:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location on the Platform
• Your contact information (address, phone, email)
• A statement of good faith belief that use is unauthorized
• A statement that information in the notice is accurate and, under penalty of perjury, you are authorized to act
• Your physical or electronic signature

Repeat Infringer Policy: We may terminate accounts of repeat copyright infringers.

8.4 Platform Intellectual Property

• The Alladro app, logo, design, and technology are owned by us and protected by copyright, trademark, and other laws
• You may not copy, modify, distribute, sell, or reverse engineer any part of the Service
• All trademarks, service marks, and trade names are proprietary to Alladro or their respective owners

9. Content Removal and Moderation

9.1 No Obligation to Monitor

• No duty to monitor: We have NO obligation to monitor, review, or pre-screen user content
• No duty to remove: We have NO duty to remove content, even if reported, flagged, or clearly violating
• Discretionary removal: All content removal is at our sole discretion
• No liability for hosting: Mere hosting of content does not create liability under safe harbor provisions

9.2 Reporting System

• Users may report inappropriate, illegal, or violating content through the in-app reporting feature
• No guarantee of action: Reporting does NOT guarantee content review, removal, or any action
• No response obligation: We have NO obligation to respond to reports or inform you of outcomes
• Discretionary review: We may review reports at our discretion, with no timeline commitment
• False reporting: Abuse of the reporting system may result in account termination

9.3 Moderation Practices

• We may use automated systems, AI tools, or human moderators to review content
• Moderation decisions are discretionary and final
• We are not obligated to provide reasons for content removal or account suspension
• Moderation may be delayed; violating content may remain visible temporarily
• We are not liable for over-moderation (removing lawful content) or under-moderation (failing to remove violating content)

9.4 Content Removal Rights

We reserve the right, but not the obligation, to:

• Remove, edit, or modify any content at any time for any reason or no reason
• Suspend or terminate accounts without notice or explanation
• Disclose user information to law enforcement or pursuant to legal process
• Cooperate with investigations or legal proceedings
• Refuse service to anyone for any reason

10. Privacy and Data Protection

10.1 Privacy Policy

• Your privacy is governed by our separate Privacy Policy, incorporated by reference
• By using the Service, you consent to our data practices as described in the Privacy Policy

10.2 Public Content Warning

• No guarantee of privacy: Content you post (crime reports, images, comments, votes) is PUBLIC and visible to all users and potentially the general public
• Geolocation disclosure: Your precise geolocation data is published with your crime reports
• Username visibility: Your username is associated with all content you post
• No deletion guarantee: Deleted content may persist in backups, caches, or third-party copies
• Third party access: Public content may be indexed by search engines, archived, or republished by third parties

10.3 Data Processing

• We may process your data as necessary for service operation, analytics, and improvement
• We use third-party service providers (Supabase, Google, etc.) who may access your data
• Your data may be stored and processed outside your country of residence
• We comply with applicable data protection laws including GDPR where applicable

11. Geographic Restrictions and International Use

11.1 International Access

• The Service may be accessed internationally, but is operated from Italy
• We make no representation that the Service is appropriate or available in all locations
• Access from territories where content is illegal is prohibited

11.2 User Compliance with Local Laws

• Your responsibility: You are solely responsible for compliance with all applicable local, national, and international laws
• Export controls: You must comply with all export control and sanctions laws
• No guarantee of legal compliance: We do NOT guarantee compliance with laws in all jurisdictions
• Local prohibitions: If use of the Service is prohibited in your location, you must not access it

12. Account Termination and Suspension

12.1 Termination Rights

• Immediate termination: We may terminate or suspend your account immediately, without notice, for any reason or no reason, including:
  • Violation of these Terms
  • Suspected illegal activity
  • Abuse of the reporting system
  • Multiple violations or warnings
  • At our sole discretion for any reason
• No refund: No refunds or compensation for terminated accounts (if paid services exist)
• Content deletion: We may (but are not obligated to) delete your content upon termination

12.2 Effect of Termination

• Upon termination, your right to access and use the Service immediately ceases
• Sections of these Terms that by their nature should survive termination shall survive, including: indemnification, limitation of liability, disclaimers, intellectual property licenses, and dispute resolution
• We are not liable for any termination of your account or deletion of your data

12.3 User-Initiated Termination

• You may terminate your account at any time by contacting us or using in-app account deletion (if available)
• Termination does not relieve you of obligations incurred prior to termination
• Your content license grant survives termination

13. Changes to Terms

• Right to modify: We reserve the right to modify, amend, or replace these Terms at any time, in our sole discretion
• Notice of changes: Changes are effective immediately upon posting to the Platform or as otherwise specified
• Notification: We may (but are not obligated to) notify you of material changes via email or in-app notification
• Continued use constitutes acceptance: Your continued use of the Service after changes constitutes acceptance of the modified Terms
• Review obligation: You are responsible for reviewing these Terms periodically
• Objection: If you do not agree to modified Terms, you must stop using the Service

14. Governing Law, Jurisdiction, and Dispute Resolution

14.1 Governing Law

• These Terms and your use of the Service are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law principles
• The United Nations Convention on Contracts for the International Sale of Goods does NOT apply

14.2 Exclusive Jurisdiction and Venue

• Italian courts: The courts of Italy shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service
• Mandatory venue: You irrevocably consent to the exclusive jurisdiction of Italian courts
• Waiver of objections: You waive any objection to venue or inconvenient forum

14.3 Class Action Waiver

• You agree to resolve disputes with us on an individual basis only
• You waive the right to participate in class actions, class arbitrations, or representative actions
• You may not consolidate or join claims with other users
• This waiver applies even if the individual dispute resolution process is found unenforceable

14.4 Limitation Period for Claims

• Any claim or cause of action arising from or relating to the Service or these Terms must be filed within ONE (1) YEAR after the claim arose
• Failure to file within this period forever bars the claim

15. Miscellaneous Provisions

15.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired. Invalid provisions shall be reformed to the minimum extent necessary to make them valid and enforceable.

15.2 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published on the Platform, constitute the entire agreement between you and Alladro regarding the Service and supersede all prior agreements, understandings, and communications.

15.3 No Waiver

• Our failure to enforce any right or provision of these Terms does not constitute a waiver
• No waiver shall be effective unless in writing and signed by us
• Waiver of one breach does not waive subsequent breaches

15.4 Assignment

• We may assign, transfer, or delegate these Terms and our rights and obligations without restriction
• You may NOT assign or transfer these Terms or your account without our prior written consent
• Any attempted assignment by you is void

15.5 Force Majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15.6 No Agency Relationship

No agency, partnership, joint venture, or employment relationship is created between you and Alladro as a result of these Terms or your use of the Service.

15.7 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated.

15.8 Interpretation

• Headings are for convenience only and do not affect interpretation
• "Including" means "including but not limited to"
• "Or" is not exclusive
• Singular includes plural and vice versa

17. Emergency Services Disclaimer

• NOT AN EMERGENCY SERVICE: Alladro is NOT an emergency service, 911 alternative, or law enforcement communication system
• DO NOT RELY FOR EMERGENCIES: Do NOT rely on Alladro to report crimes in progress, request emergency assistance, or obtain emergency response
• CALL AUTHORITIES DIRECTLY: For emergencies, ALWAYS contact local police (112 in EU, 911 in US) or emergency services directly via telephone
• NO EMERGENCY RESPONSE: We do NOT provide emergency response services, dispatch emergency personnel, or notify law enforcement
• DELAYED REPORTING: Crime reports posted to Alladro are NOT reviewed in real-time and may NOT reach law enforcement
• NO MONITORING: We do NOT monitor content for emergency situations requiring immediate response
• LIFE-THREATENING SITUATIONS: In life-threatening situations, call emergency services immediately; do not post to Alladro first
• NO LIABILITY FOR EMERGENCY DELAYS: We are NOT liable for any harm, injury, or damage resulting from reliance on Alladro instead of contacting emergency services

18. Age Restrictions and Parental Consent

• Minimum age: You must be at least 13 years old to use the Service
• Parental consent: If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have parental or guardian consent to use the Service
• Age verification: We may request age verification at any time
• Termination for minors: We may immediately terminate accounts of users under 13 or who lack required parental consent
• Parent responsibility: Parents/guardians are responsible for monitoring minors' use of the Service

19. Acknowledgment and Acceptance

• You have read, understood, and agree to be bound by these Terms of Service in their entirety
• You have read and understood all disclaimers, limitations of liability, and warnings
• You understand that Alladro is NOT a law enforcement service, emergency service, or crime prevention service
• You understand that all content is user-generated, unverified, and may be false or misleading
• You understand that you are solely responsible for all content you post
• You agree to indemnify Alladro against all claims arising from your use of the Service
• You accept all risks associated with using the Service
• You consent to the exclusive jurisdiction of Italian courts
• You waive the right to participate in class actions
• You agree that Alladro's total liability is capped at €100
